These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and Joey Jazwinski ("we", "us", "our") governing your access to and use of joeyjazwinski.com, including any subdomains, interactive features, developer utilities, educational modules, blogs, and API services (collectively, the "Platform").

By accessing the Platform, creating an account, or checking the terms acknowledgment box on registration, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately refrain from accessing or using the Platform.

To access certain features of the Platform (such as course tracking, personalized developer profiles, or custom UI settings), you may be required to register an account:

• Accurate Information: You agree to provide accurate, current, and complete registration details and maintain their accuracy.
• Credential Confidentiality: You are responsible for safeguarding your password and account security tokens. You agree not to disclose your password to any third party.
• Account Responsibility: You are solely responsible for any activity or actions under your account, whether authorized by you or not.
• Age Requirement: You represent and warrant that you are at least 13 years of age. If you are between 13 and 18, you represent that you have legal guardian consent to use this Platform.

You agree to use the Platform only for lawful purposes in accordance with these Terms. You agree NOT to:

• Attempt to bypass, compromise, or probe vulnerabilities in our authentication protocols, rate limiters, or server endpoints.

• Impersonate Joey Jazwinski, another user, or any entity, or falsely claim affiliation with our platform.
• Overload, flood, spam, or perform denial-of-service (DoS/DDoS) operations against our hosting infrastructure or APIs.
• Use our developer tools or learning tracks for any unlawful, deceptive, or malicious hacking operations.

The Platform and its entire contents, features, and functionality (including all software code, visual design, custom UI components, tutorials, text, graphics, animations, and branding) are the exclusive property of Joey Jazwinski and are protected by United States and international copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and view platform content for personal, non-commercial educational use. Open-source repositories explicitly published under open licenses (e.g. MIT) remain governed by their respective license declarations.

Users may submit feedback, comments, and profile information ("User Content"). By posting User Content to the Platform, you grant us a worldwide, royalty-free, perpetual license to display, adapt, and distribute such content in connection with operating and promoting the Platform.

We reserve the absolute right (but not the obligation) to review, moderate, remove, or edit any User Content that violates these Terms or is otherwise deemed objectionable, profane, defamatory, or harmful.

The Platform may contain links to external third-party websites, code repositories (e.g. GitHub), or professional profiles (e.g. LinkedIn). We do not control and are not responsible for the content, privacy policies, or practices of any third-party websites or services. Accessing third-party resources is entirely at your own risk.

To the maximum extent permitted by applicable law, in no event shall Joey Jazwinski, its affiliates, or contributors be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages—including but not limited to loss of profits, loss of data, loss of business goodwill, computer failures, or business interruption—arising out of or related to your use of or inability to use the Platform.

We reserve the right, without prior notice or liability, to suspend, disable, or permanently terminate your account or revoke your access to the Platform if you breach any provision of these Terms or engage in conduct that harms the integrity of our systems or community.

You may terminate your account at any time by contacting us to request account closure and deletion of your stored records.

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles. Any legal claim or proceeding arising out of or related to the Platform shall be instituted exclusively in the state or federal courts situated in New York.

We reserve the right to revise, update, or modify these Terms at our sole discretion. Any changes will become effective immediately upon being published on the Platform with an updated "Last Updated" date.

Your continued use of the Platform after changes have been posted constitutes your binding agreement to the amended Terms.
